Terms of Service
Effective date: September 25, 2026
Last revised: September 25, 2026
These Terms of Service (the "Terms") are a binding agreement between you and Reese Barnett, an individual doing business as Fam Friends ("Fam Friends", "we", "us", "our"). They govern your use of the Fam Friends iOS app (the "App"), our website at www.famfriends.app and join.famfriends.app (the "Website"), and the emails and notifications we send (together, the "Services").
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy at https://www.famfriends.app/privacy, which is part of these Terms. If you do not agree, do not use the Services.

1. Who can use Fam Friends
You must be at least 13 years old to use the Services, or older if the law where you live sets a higher age for agreeing to terms like these or for using online services without a parent's consent. We ask for your birthdate at sign-up and refuse accounts that do not meet the minimum age. If you are under 18, you confirm that a parent or legal guardian has reviewed these Terms and agrees to them on your behalf.
You must not use the Services if you have previously been removed from them by us, or if using them would break a law that applies to you.
The Services are offered from the United States. If you use them from somewhere else, you are responsible for following your local laws.
2. Your account
Sign-in. Fam Friends has no passwords. You sign in with a one-time code sent to your email address, or with Sign in with Apple or Sign in with Google. Your email address identifies your account, so keep control of that mailbox and of any Apple or Google account you sign in with. Anything done while signed in to your account is your responsibility until you tell us otherwise.
Accurate information. The information you give us, including your birthdate and display name, must be true. We may suspend or close an account created with false information.
One person, one account. Your account is for you personally. Do not share it, sell it, transfer it, or create an account for someone else.
Security. If you believe someone else has used your account, email support+privacy@famfriends.app right away.
3. Groups, roles, and invitations
How groups work. Fam Friends is built around small, private groups. Each group runs a monthly cycle: members receive prompts, answer them, and at the end of the cycle the group receives a newsletter built from those answers. Groups have an owner, may have editors, and have members. Each plan sets limits on how many groups you can own and how many members a group can have.
Owners and editors. If you own or edit a group, you are responsible for how you run it. That includes who you invite, whether you approve join requests, and the choices you make during a newsletter's review window, such as regenerating, publishing, or withholding it. Owners and editors can see members' answers before the newsletter is published and must treat them with the care the group would expect.
Inviting people. When you invite someone by email, you confirm that you know them and that they would reasonably expect to hear from you. Do not invite strangers, and do not use invitations to send unsolicited messages.
Invite links. A group's invite link opens a public page showing the group's name and photo to anyone who has the link, and lets them request to join. You are responsible for where you share a link. If a link gets into the wrong hands, the owner can regenerate it from inside the App.
Your fellow members. What other members share is for the group. Do not copy members' answers, photos, or newsletters outside the group without their permission. Other members are responsible for what they post; we are not.
Leaving and read-only groups. You can leave a group at any time. If a group's owner deletes their account, a group with other members becomes permanently read-only: its newsletters stay readable, but no new cycles run.
4. Your content
You own it. You keep all rights to the text, choices, photos, group names, and other content you submit ("Your Content"). We do not claim ownership of it, and we do not sell it or license it to anyone for their own purposes.
The license you give us. So that we can run the Services, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, and display Your Content, and to create newsletters from it, including with the AI model described in Section 5, solely to provide the Services to you and your groups. This includes copying an answer into another of your groups when you choose to share it there.
How long the license lasts. The license ends when Your Content is deleted from the Services, with one exception you should understand before you post. Newsletters are the group's shared record. Once a newsletter is published, Your Content in it stays part of that newsletter, with your name as it was at publication, for as long as the group exists, even if you leave the group or delete your account. The Privacy Policy explains this in detail and how to ask us to remove specific content.
Your promises about Your Content. You confirm that:
- You created it or have the right to share it, including the rights of anyone who appears in a photo.
- Anyone identifiable in a photo you upload is someone who would reasonably expect you to share that photo with your group. Be especially careful with photos of children.
- It does not break any law, infringe anyone's rights, or violate Section 6.
- It is not private information about someone else, such as their health, finances, or contact details, shared without their consent.
Anonymous prompts. Some prompts are shown to the group without your name. We keep those anonymous in what we display, but the content itself may still identify you to people who know you. Write accordingly.
We may remove content. We may remove or hide content, or withhold a newsletter, if we believe it violates these Terms or the law, or to protect someone's safety. We are not obliged to review content before it appears, and we do not pre-screen it.
5. Newsletters and AI-generated content
Newsletters are generated by software. At the end of each cycle, the narrative parts of a newsletter are written by an AI model from the group's answers, as the Privacy Policy describes. The model can make mistakes: it may misattribute something, get a detail wrong, leave something out, or phrase something in a way the writer did not intend. We run checks to reduce this, and a group's owner or editors can review a newsletter before it goes out, but we do not promise that any newsletter is accurate or complete.
Newsletters are not records of fact. Do not rely on a newsletter as an accurate account of what someone said. The original answers are available to owners and editors during review, and members are the authority on what they meant.
If something is wrong. You can report a newsletter from inside the App. Reports go to us, and the group's owner or editors can regenerate or withhold a newsletter during its review window. We may also regenerate, correct, or remove a newsletter ourselves.
Owners and editors decide. When a newsletter has a review window, the owner and editors of the group decide whether to publish it as generated, regenerate it, or withhold it. Once the window passes, a newsletter publishes automatically. Owners and editors are responsible for those decisions.
Do not try to manipulate the model. Answers are given to the model as content, not as instructions. Attempts to make the model ignore its rules, write about other people in harmful ways, or produce content that violates Section 6 are a breach of these Terms whether or not they succeed.
6. Acceptable use
Use the Services only as they are meant to be used: to share life with a small group of people who know you. You agree not to:
Harm people.
- Harass, threaten, bully, or intimidate anyone, inside or outside your groups.
- Post content that is hateful toward a person or group on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or similar characteristics.
- Post sexual content involving a minor, or content that sexualizes or endangers a child in any way. We report this to the authorities.
- Post content that promotes self-harm, violence, or illegal activity.
- Share private information about someone else without their consent.
- Impersonate any person or misrepresent who you are or your relationship to a group.
Misuse the Services.
- Use Fam Friends for advertising, promotion, recruiting, fundraising, or any commercial purpose inside a group.
- Send unsolicited invitations, or post invite links where strangers will find them.
- Create accounts by automated means, or create more than one account for yourself.
- Access the Services with scripts, bots, scrapers, or anything other than the App and the Website as we provide them.
- Collect other members' information, including email addresses, for any purpose outside the group.
- Upload files that are not what they claim to be, contain malicious code, or are designed to interfere with the Services.
- Circumvent rate limits, plan limits, age checks, or any other restriction we enforce.
- Probe, scan, or test the security of the Services without our written permission.
- Reverse engineer, decompile, or copy any part of the App or the Services, except where the law expressly allows it.
- Interfere with other people's use of the Services or place an unreasonable load on our infrastructure.
Break the law.
- Use the Services in any way that violates a law that applies to you, including intellectual property, privacy, and export laws.
7. Reporting, moderation, and enforcement
Reporting. Report a newsletter from inside the App. For anything else, including abuse by another user, email support+abuse@famfriends.app. Do not file false or bad-faith reports.
Copyright complaints. If you believe content on the Services infringes your copyright, email support+abuse@famfriends.app with a description of the work, where the content appears, your contact details, a statement that you believe in good faith the use is not authorized, and a statement under penalty of perjury that you are the owner or authorized to act for the owner. We may share your complaint with the person who posted the content. Knowingly misrepresenting that content is infringing can make you liable for damages.
What we may do. If we believe you have broken these Terms, the law, or the trust of your group, we may warn you, remove content, withhold a newsletter, suspend features, remove you from a group, suspend or close your account, and report you to law enforcement where appropriate. We decide what action fits. We will usually tell you what we did and why, unless doing so would put someone at risk or the law prevents it.
No obligation to monitor. We do not read your groups' content as a matter of course. We look at content when it is reported, when our systems flag it, or when the law requires.
8. Subscriptions and payments
Free and Paid. Fam Friends has a free plan and a paid plan, Fam Friends Paid. The plans differ in limits such as how many groups you can own, how many members a group can have, how much of a group's newsletter history you can read, and what editors can do during review. The App shows the current limits and price.
Purchases go through Apple. Fam Friends Paid is an auto-renewable subscription sold through Apple's App Store. Apple, not Fam Friends, handles billing, renewals, refunds, and price display. The App Store terms apply to every purchase, including Apple's Licensed Application End User License Agreement at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. We never see your payment details.
Automatic renewal. Your subscription renews automatically at the end of each period at the then-current price unless you cancel at least 24 hours before it renews. Cancel through your device's Settings or the App's subscription screen. Cancellation takes effect at the end of the current period; you keep paid features until then.
Free introductory periods. Where Apple offers one, an introductory free period converts to a paid subscription at the end unless you cancel first. Eligibility is determined by Apple, once per Apple account. Deleting and recreating a Fam Friends account does not earn another.
Refunds. Refund requests go to Apple, under Apple's policies. We cannot issue App Store refunds ourselves.
One subscription, one account. A subscription attaches to the Fam Friends account that bought it. If you delete that account, or detach the subscription, the subscription itself continues with Apple until you cancel it there. Deleting your account does not cancel your subscription.
Changes to plans and prices. We may change what each plan includes and what the paid plan costs. Price changes for an existing subscription are handled through Apple, which will notify you and, where required, ask for your consent before the new price applies. Changes to plan limits take effect when we publish them in the App; if a change reduces something you rely on, we will give you reasonable notice.
Downgrading. If your subscription ends, your account returns to the free plan. Nothing is deleted, but content beyond the free plan's limits, such as older newsletters, may become unreadable until you subscribe again, and you may be unable to add members or create groups beyond the free plan's limits.
9. Ending your account
By you. You can delete your account from the Profile screen at any time. The Privacy Policy explains exactly what is deleted, what happens to groups you own, and why your contributions to already-published newsletters remain with those groups. Deletion cannot be undone.
By us. We may suspend or close your account if you breach these Terms, if the law requires it, if your account has been inactive for a long time, or if we stop offering the Services. We will try to give you notice unless doing so would be harmful or is not allowed. If we close your account for breaching these Terms, you may not create another.
What survives. Sections 4 (the license for published newsletters), 5, 10, 11, and 14 through 19 survive the end of your account.
10. Our intellectual property
The App, the Website, and the Services, including their software, design, text, graphics, logos, and the Fam Friends name, belong to us or our licensors and are protected by copyright, trademark, and other laws. Newsletters are built from Your Content and your group's content; the format, templates, and generated structure around that content are ours.
We grant you a limited, personal, non-transferable, revocable license to install and use the App on Apple devices you own or control, and to use the Services, for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Services, or use our name or logo without our written permission. All rights not expressly granted are reserved.
11. Feedback
We welcome feature requests and other feedback, from inside the App or by email. By sending feedback, you agree that we may use it freely, including to build features, without any obligation to you and without compensation. You keep any rights you have in it, but you grant us a perpetual, irrevocable, royalty-free license to use it. Do not send feedback you consider confidential or that belongs to someone else.
12. Third-party services
The Services depend on services we do not control, including Apple (Sign in with Apple, push notifications, the App Store), Google (Sign in with Google), and Amazon Web Services (hosting and AI generation). Your use of Apple's and Google's services is governed by their terms and privacy policies. We are not responsible for those services, for their availability, or for changes they make that affect the Services.
13. Terms required by Apple
Because the App is distributed through Apple's App Store, Apple requires these Terms to say the following:
- These Terms are between you and Fam Friends only, not Apple. Apple is not responsible for the App or its content.
- Your license to use the App is limited to Apple-branded devices that you own or control, as permitted by the App Store terms, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing where available.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar laws.
- If a third party claims that the App infringes its intellectual property rights, we, not Apple, are responsible for investigating, defending, settling, and discharging the claim.
- You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You must comply with applicable third-party terms when using the App, such as your wireless data service agreement.

WITHOUT LIMITING THAT, WE DO NOT PROMISE THAT:

- YOUR CONTENT WILL BE PRESERVED. YOU ARE RESPONSIBLE FOR KEEPING YOUR OWN COPIES OF ANYTHING YOU CARE ABOUT.
- PROMPTS, REMINDERS, NOTIFICATIONS, OR EMAILS WILL BE DELIVERED ON TIME OR AT ALL.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FAM FRIENDS AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, CONTENT, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE APP STORE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS (US$100).
THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR FOR FRAUD. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
16. Indemnification
You agree to defend, indemnify, and hold harmless Fam Friends and its service providers from any claim, demand, loss, liability, damage, cost, or expense, including reasonable legal fees, arising out of or relating to: Your Content; your use of the Services; your breach of these Terms; your violation of any law or of anyone's rights, including privacy, publicity, and intellectual property rights; or any harm you cause to another user. We may take over the defense of any matter you must indemnify us for, at your expense, and you agree to cooperate with us.
17. Governing law and disputes
Talk to us first. If you have a problem with the Services, email support+app@famfriends.app and we will try to resolve it with you. Most problems can be fixed this way. You agree to try informal resolution for at least 30 days before starting any formal proceeding.
Governing law. These Terms and any dispute between you and us are governed by the laws of the District of Columbia, United States, without regard to its conflict-of-law rules, and by U.S. federal law where applicable. If you are a consumer in a jurisdiction whose law gives you protections that cannot be waived by contract, you keep those protections.
Where disputes are heard. Any dispute that cannot be resolved informally will be brought in the Superior Court of the District of Columbia or the United States District Court for the District of Columbia, and you and we consent to the personal jurisdiction of those courts. Either of us may instead bring an eligible claim in small claims court where you live.
Time limit. To the extent the law allows, any claim relating to the Services must be brought within one year after it arose, or it is permanently barred.
California residents. If a complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
18. Changes to the Services and these Terms
The Services. Fam Friends is a small, evolving product. We may add, change, or remove features, prompts, plan limits, and other parts of the Services at any time. We may also suspend or discontinue the Services entirely; if we do, we will give you reasonable notice and a chance to save your content where practical.
These Terms. We may update these Terms. When we do, we will post the new version at https://www.famfriends.app/terms and change the "Last revised" date at the top. If a change materially affects your rights, we will notify you in the App or by email at least 30 days before it takes effect, and where the law requires it we will ask for your agreement. Continuing to use the Services after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Services and delete your account.
19. General terms
Entire agreement. These Terms, together with the Privacy Policy and any additional terms shown in the App for a specific feature, are the whole agreement between you and us about the Services.
Electronic communications. You agree that we may communicate with you electronically, through the App, by push notification, and by email to the address on your account, and that those communications satisfy any legal requirement that a communication be in writing.
Assignment. You may not transfer these Terms or your account to anyone else. We may assign these Terms to a successor to our business, including a company later formed to operate Fam Friends, and will tell you if we do.
No waiver. If we do not enforce a part of these Terms, that is not a waiver of our right to enforce it later.
Severability. If any part of these Terms is found unenforceable, the rest remains in effect, and the unenforceable part will be modified to the minimum extent needed to make it enforceable.
Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control, including outages at our service providers.
No relationship. These Terms do not create any partnership, employment, agency, or joint venture between you and us.
Interpretation. Headings are for convenience only. "Including" means "including without limitation". These Terms will not be construed against us because we drafted them.
